IndiGo airlines, a low cost carrier owned by InterGlobe Aviation Limited, has filed a lawsuit against Mahindra for using the term “6e” in its new electric vehicle (EV), the BE 6e. The lawsuit, filed in the Delhi High Court, alleges trademark infringement. It is claimed that Mahindra’s use of “6e” violates the registered trademark rights of IndiGo, which has been using the same term for its flights.
In a statement, Mahindra has said that it is in talks with IndiGo, and is trying to find a possible solution. As claimed, the brand has already filed a trademark registration application for its BE 6e.
IATA (International Air Transport Association) assigns a unique 2-character code to all airlines and IndiGo’s IATA code is “6e”, which is widely recognised by the public and in aviation. The airline uses this code not only on its airplanes or tickets but also in various marketing related activities.
In response to IndiGo, Mahindra has issued a clarification, “Mahindra revealed its electric origin SUVs the BE 6e and XEV 9e on November 26, 2024. Mahindra has applied for trade mark registration under class 12 (vehicles) for “BE 6e” a part of its electric origin SUV portfolio. We hence don’t see a conflict as Mahindra’s mark is “BE 6e,” not the standalone “6E.” It differs fundamentally from Indigo’s “6E,” which represents an airline, eliminating any risk of confusion. The distinct styling further emphasizes their uniqueness.”
“We have taken on board the concerns that InterGlobe Aviation Limited have to infringement of their goodwill, which was not our intention . We are engaged in discussions with them to find an amicable solution,” it added further.
A final solution for this fiasco has yet to come to light and we will update this space once an appropriate response and solution comes to light.
In Chennai, Mahindra recently revealed its two new electric SUVs, called the BE 6e and XEV 9e, priced at Rs 18.90 lakh (ex-showroom) and Rs 21.90 lakh (ex-showroom), respectively. Both modes use an EV-only INGLO platform, and offer the option of two battery packs. That said, the customer deliveries of the BE 6e and XEV 9e are set to commence in February or March 2025.
